Le Groupe d’éducation et d’écosurveillance de l’eau (G3E) a établi des politiques visant à assurer l’expérience la plus agréable possible pour tous lors de l’utilisation de l’application Cours d’eau branchés. Nous vous invitons à les consulter.

IL EST IMPORTANT DE LIRE ATTENTIVEMENT TOUTES LES POLITIQUES ET CONDITIONS D’UTILISATION.

Le G3E est propriétaire et administrateur de l’application Cours d’eau branchés et des services technologiques afférents (ci-après nommés « Cours d’eau branchés »). La présente entente d’utilisation (ci-après « l’entente ») stipule les conditions d’accès et d’utilisation de Cours d’eau branchés. Lorsque vous visitez et utilisez Cours d’eau branchés, vous acceptez d’être lié par les conditions de la présente entente. SI VOUS N’ÊTES PAS D’ACCORD AVEC LES CONDITIONS, RÈGLES, POLITIQUES, LIGNES DIRECTRICES OU PRATIQUES DU G3E DANS LE CADRE DE L’EXPLOITATION DE COURS D’EAU BRANCHÉS, VOTRE SEUL ET UNIQUE RECOURS EST DE CESSER DE L’UTILISER.

Le G3E peut réviser la présente entente à tout moment.

Une utilisation de Cours d’eau branchés postérieure à l’affichage de telles modifications équivaudra à l’acceptation des conditions révisées. Vous êtes donc invité à consulter périodiquement les présentes politiques et conditions d’utilisation.

Propriété

Tout ce qui est affiché ou par ailleurs accessible par l’intermédiaire de Cours d’eau branchés, y compris, notamment, les articles, les textes, les photographies, les images, les illustrations, les clips audio, les clips vidéo, les logiciels et les codes (collectivement « le contenu »), est protégé par les lois canadiennes et étrangères, notamment en matière de droit d’auteur, et appartiennent au G3E, à ses concédants de licence ou à la personne reconnue comme étant le fournisseur du contenu.

Cours d’eau branchés est par ailleurs protégé en vertu de la législation sur le droit d’auteur en tant que recueil et/ou compilation au sens des lois canadiennes et étrangères. Vous devez respecter l’ensemble des autres avis de droit d’auteur, renseignements et restrictions relatifs au contenu auquel on peut accéder par l’intermédiaire de Cours d’eau branchés. L’UTILISATION, LA REPRODUCTION, LA MODIFICATION, L’EXÉCUTION PUBLIQUE OU LA MISE À LA DISPOSITION DU PUBLIC, LE TÉLÉCHARGEMENT OU L’AFFICHAGE SUR INTERNET, LA TRANSMISSION, LA REDISTRIBUTION OU QUELQUE AUTRE EXPLOITATION DE COURS D’EAU BRANCHÉS OU DE TOUT CONTENU, EN TOTALITÉ OU EN PARTIE, SAUF DANS LES CONDITIONS EXPRESSÉMENT PRÉVUES PAR LES PRÉSENTES (OU EXPRESSÉMENT MENTIONNÉES DANS COURS D’EAU BRANCHÉS), SONT INTERDITS SANS LA PERMISSION ÉCRITE EXPRESSE DU G3E.

Marques de commerce

Cours d’eau branchés est la propriété officielle du G3E. D’autres noms, mots, titres, phrases, logos, dessins, graphiques, icônes et marques de commerce affichés dans Cours d’eau branchés peuvent constituer des marques de commerce enregistrées ou non du G3E ou de tiers. Même si le G3E peut utiliser sous licence certaines marques de commerce de tiers, l’affichage de telles marques de commerce dans Cours d’eau branchés ne permet de présupposer aucune relation ou licence entre le G3E et le propriétaire de la marque de commerce en question, ni l’approbation de la marchandise, des services ou des activités du propriétaire de cette marque de commerce par le G3E. Aucun élément contenu dans Cours d’eau branchés ne saurait être interprété de manière à vous concéder une licence ou un droit d’utilisation de quelque logo, dessin ou marque de commerce du G3E ou d’un tiers, sans la permission écrite du G3E ou du propriétaire d’une marque de commerce de tiers.

COURS D’EAU BRANCHÉS ET L’ENSEMBLE DU CONTENU SONT FOURNIS TELS QUELS. LORSQUE VOUS VISITEZ ET UTILISEZ COURS D’EAU BRANCHÉS, VOUS RECONNAISSEZ ET CONVENEZ QUE VOUS LE FAITES ENTIÈREMENT À VOS RISQUES. LE G3E NE FORMULE AUCUNE DÉCLARATION NI GARANTIE :

QUANT À L’EXACTITUDE, À L’EXHAUSTIVITÉ, À LA FIABILITÉ OU À L’À-PROPOS DE SON CONTENU;
QUANT À LA QUALITÉ MARCHANDE OU QUANT À L’ADAPTATION À UN USAGE PARTICULIER DU CONTENU, Y COMPRIS LA QUALITÉ MARCHANDE OU L’ADAPTATION, NOTAMMENT, DE QUELQUE INFORMATION, DONNÉE, LOGICIEL, PRODUIT OU SERVICE CONTENU DANS COURS D’EAU BRANCHÉS OU OFFERT PAR L’INTERMÉDIAIRE DE COURS D’EAU BRANCHÉS;
QUANT AU FONCTIONNEMENT DE COURS D’EAU BRANCHÉS SANS INTERRUPTION NI ERREUR;
QUANT À LA CORRECTION DES DÉFAUTS OU ERREURS DANS COURS D’EAU BRANCHÉS;
QUANT À L’ABSENCE DE VIRUS OU D’ÉLÉMENTS DOMMAGEABLES DANS COURS D’EAU BRANCHÉS; ET
QUANT À LA TRANSMISSION SÉCURITAIRE OU SANS INTERCEPTION DES COMMUNICATIONS PAR L’INTERMÉDIAIRE DE COURS D’EAU BRANCHÉS.

Inscription

Vous pouvez accéder à la plus grande partie du contenu de Cours d’eau branchés sans vous inscrire et sans nous fournir de renseignements personnels. Toutefois, pour pouvoir utiliser certaines fonctions de Cours d’eau branchés, vous pouvez être prié de vous inscrire. Vous convenez i) de fournir des renseignements véridiques, exacts, à jour et complets vous concernant lorsque vous êtes invité à les donner dans un formulaire d’inscription; et ii) de maintenir et de mettre à jour sans délai l’information que vous fournissez afin de la garder véridique, exacte, à jour et complète. Il vous incombe de préserver la confidentialité de votre mot de passe et de votre compte, et vous êtes responsable de l’ensemble des activités effectuées au moyen de ceux-ci. Vous convenez d’aviser le G3E immédiatement de toute utilisation non autorisée de votre mot de passe ou de votre compte ou de toute autre atteinte à la sécurité, et de vous assurer de quitter votre compte à la fin de chaque session. Le G3E ne saurait être tenu responsable de quelque perte ou dommage découlant du défaut du G3E ou de votre défaut de protéger votre mot de passe ou l’information concernant votre compte.

Les renseignements recueillis lors de l’inscription permettent au G3E de créer votre compte et de vous assurer un accès facile et personnalisé à celui-ci. Ils permettent aussi au G3E d’offrir et d’assurer les services de Cours d’eau branchés. Ces renseignements lui permettent également de communiquer avec vous au sujet de votre utilisation de Cours d’eau branchés et des mises à jour logicielles, et de répondre à vos demandes d’assistance (y compris l’assistance pour la vérification de compte si vous avez de la difficulté à accéder au vôtre). Confidentialité

Dès que vous accédez à Cours d’eau branchés, certaines données sont transmises automatiquement au G3E. Ces données sont recueillies en vertu des exigences technologiques propres à la navigation sur Internet et aux applications mobiles et ne sont utilisées qu’à des fins statistiques.

Cours d’eau branchés recueille et reçoit de l’information en provenance de votre appareil mobile, le nom (ou nom d’usager), le courriel, le mot de passe, les coordonnées géographiques, les photos et les informations saisies pour les stations documentées.

Sur demande, il est possible d’anonymiser les stations d’un utilisateur en transférant ses stations dans un compte anonyme et en désactivant le compte utilisateur. Les photos, les coordonnées géographiques, les textes saisis seraient toujours visibles, mais sans être associés à un utilisateur.

Le G3E assure l’anonymat des renseignements qu’il conserve et dont il a besoin pour déterminer le nombre de visiteurs, les pages les plus fréquentées, la technologie utilisée, les sites référents et le pays d’origine des utilisateurs, etc.

Il est conseillé aux utilisateurs de Cours d’eau branchés de ne pas communiquer de renseignements personnels, ou de prendre des mesures de sécurité appropriées s’ils le font.

Toutefois, si vous décidez de nous transmettre de l’information personnelle (en nous envoyant un message par courrier électronique ou par un autre moyen par l’intermédiaire de Cours d’eau branchés), le G3E prend les engagements suivants :

Il n’utilisera que l’information nécessaire pour donner suite à votre message;

Seules les personnes ayant qualité pour la recevoir au G3E auront accès à cette information et elles ne pourront la consulter que lorsque cela sera nécessaire à l’exercice de leurs fonctions;

Les renseignements personnels détenus par le G3E seront utilisés aux seules fins pour lesquelles ils ont été recueillis. Ils seront archivés ou détruits par des procédés sécuritaires lorsqu’ils ne seront plus nécessaires;

Les renseignements personnels que vous nous transmettrez ne seront communiqués à une personne ou à un organisme (y compris à un organisme gouvernemental) que dans les cas où cette communication sera autorisée par la loi;

Limitation de responsabilité

SOUS RÉSERVE DE LA LÉGISLATION APPLICABLE, LE G3E ET SES DIRIGEANTS, ADMINISTRATEURS, EMPLOYÉS, MANDATAIRES, CONCÉDANTS DE LICENCE OU LEURS SUCCESSEURS ET AYANTS DROIT RESPECTIFS NE SAURAIENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DE QUELQUE DOMMAGE SPÉCIAL, INDIRECT OU ACCESSOIRE, DE QUELQUE NATURE, Y COMPRIS, NOTAMMENT, DE QUELQUE PERTE OU DOMMAGE DE LA NATURE OU RELEVANT D’UNE PERTE D’AFFAIRES, D’UNE PERTE D’ÉCONOMIES, D’UNE PERTE DE DONNÉES ET/OU D’UNE PERTE DE PROFITS, QUELLE QU’EN SOIT LA CAUSE, ET QU’IL SOIT OU NON FONDÉ SUR UN CONTRAT (Y COMPRIS LE MANQUEMENT À UNE OBLIGATION ESSENTIELLE), LA RESPONSABILITÉ CIVILE (Y COMPRIS LA NÉGLIGENCE) OU AUTREMENT FONDÉ, MÊME SI LE G3E CONNAISSAIT OU AURAIT DÛ CONNAÎTRE LA POSSIBILITÉ DE TELS DOMMAGES.

LE G3E ET SES DIRIGEANTS, ADMINISTRATEURS, EMPLOYÉS, MANDATAIRES, CONCÉDANTS DE LICENCE OU LEURS SUCCESSEURS ET AYANTS DROIT RESPECTIFS NE SAURAIENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DE QUELQUE DOMMAGE OU PERTE AUX TERMES DE LA PRÉSENTE ENTENTE, QU’IL SOIT OU NON FONDÉ SUR UN CONTRAT (Y COMPRIS LE MANQUEMENT À UNE OBLIGATION ESSENTIELLE), LA RESPONSABILITÉ CIVILE (Y COMPRIS LA NÉGLIGENCE) OU AUTREMENT, EN EXCÉDENT DE CENT DOLLARS CANADIENS (100 $ CA), MÊME SI LE G3E CONNAISSAIT OU AURAIT DÛ CONNAÎTRE LA POSSIBILITÉ DE TELS DOMMAGES. LE G3E ET SES DIRIGEANTS, ADMINISTRATEURS, EMPLOYÉS, MANDATAIRES, CONCÉDANTS DE LICENCE OU LEURS SUCCESSEURS ET AYANTS DROIT RESPECTIFS NE SAURAIENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DE QUELQUE PERTE OU DOMMAGE DÉCOULANT DU DÉFAUT DU G3E OU DE VOTRE DÉFAUT DE PROTÉGER VOTRE MOT DE PASSE OU L’INFORMATION RELATIVE À VOTRE COMPTE. LE G3E DÉCLINE EXPRESSÉMENT TOUTE RESPONSABILITÉ À L’ÉGARD DES ACTES, DES OMISSIONS OU DE LA CONDUITE DE QUELQUE TIERS UTILISATEUR DE COURS D’EAU BRANCHÉS OU DE QUELQUE ANNONCEUR OU COMMANDITAIRE DE COURS D’EAU BRANCHÉS (COLLECTIVEMENT, UN « TIERS UTILISATEUR »).

LE G3E ET SES DIRIGEANTS, ADMINISTRATEURS, EMPLOYÉS, MANDATAIRES OU CONCÉDANTS DE LICENCE OU LEURS SUCCESSEURS ET AYANTS DROIT RESPECTIFS NE SAURAIENT EN AUCUN CAS ÊTRE TENUS RESPONSABLES DE QUELQUE PRÉJUDICE, PERTE, DOMMAGE (Y COMPRIS LES DOMMAGES SPÉCIAUX, INDIRECTS OU ACCESSOIRES) NI D’AUCUNS FRAIS DÉCOULANT DE QUELQUE MANIÈRE I) DES ACTES, DES OMISSIONS OU DE LA CONDUITE D’UN TIERS UTILISATEUR; ET II) DE L’UTILISATION OU DE L’INCAPACITÉ D’UTILISER QUOI QUE CE SOIT, LOGICIEL, CONTENU, BIENS OU SERVICES D’UN SITE OU OFFERT PAR L’INTERMÉDIAIRE D’UN SITE LIÉ À COURS D’EAU BRANCHÉS.

SI VOUS DÉCIDEZ DE VISITER OU D’UTILISER UN SITE LIÉ À COURS D’EAU BRANCHÉS, OU DU CONTENU, DU MATÉRIEL, DES LOGICIELS, DES BIENS OU DES SERVICES À PARTIR D’UN SITE LUI-MÊME LIÉ À COURS D’EAU BRANCHÉS, VOUS LE FAITES ENTIÈREMENT À VOS RISQUES.

PAR LA PRÉSENTE ENTENTE, VOUS DÉGAGEZ LE G3E ET SES DIRIGEANTS, ADMINISTRATEURS, MANDATAIRES ET LEURS SUCCESSEURS ET AYANTS DROIT RESPECTIFS DE TOUTE RESPONSABILITÉ À L’ÉGARD DE QUELQUE DOMMAGE QUE VOUS POURRIEZ SUBIR, ET VOUS CONVENEZ DE NE PAS FAIRE VALOIR CONTRE EUX QUELQUE RÉCLAMATION DÉCOULANT DE VOTRE ACHAT OU DE VOTRE UTILISATION DE PRODUITS OU SERVICES OFFERTS PAR L’INTERMÉDIAIRE DE COURS D’EAU BRANCHÉS, NOTAMMENT PAR DES TIERS.

Résiliation

Le G3E peut à tout moment, sans avis, à son absolue discrétion et sans motif, mettre fin à votre droit de visite et d’utilisation de Cours d’eau branchés (ou d’une partie de celui-ci). Le G3E peut également mettre fin à votre droit de visite et d’utilisation de Cours d’eau branchés, ou d’une partie de celui-ci, si vous manquez à l’une des conditions de la présente entente.

Licences d’utilisation du logiciel et propriété

Tous les logiciels intégrés dans Cours d’eau branchés ou qui s’y trouvent, y compris, notamment, tout type de code machine et l’ensemble des fichiers et/ou images contenus ou générés par ces logiciels, sont protégés par droit d’auteur et peuvent être protégés par d’autres droits. Tous ces logiciels appartiennent au G3E, à ses concédants de licence ou aux parties reconnues propriétaires. Vous êtes par les présentes autorisé à accéder aux logiciels intégrés à Cours d’eau branchés et à les utiliser, sous réserve i) des conditions de la présente entente et ii) des autres conditions d’accès à ces logiciels et d’utilisation de ceux-ci qui peuvent être imposées. Si Cours d’eau branchés offre le téléchargement de logiciels, sauf disposition contraire, vous recevez par les présentes, sous réserve i) des conditions de la présente entente et ii) des autres conditions pouvant s’appliquer au téléchargement et à l’utilisation de ces logiciels, une licence non exclusive, incessible et personnelle i) d’installation et d’exploitation d’une copie des logiciels en format code objet sur un ordinateur hors réseau à des fins personnelles et non commerciales et ii) de reproduction du logiciel dans la mesure raisonnablement nécessaire à son installation et à son exploitation, et à la création de copies de sauvegarde raisonnables tel que le permet la loi. Sauf dans la mesure expressément permise dans la présente entente, il vous est interdit i) d’utiliser, de reproduire, de modifier, d’adapter, de traduire, de télécharger ou de transmettre les logiciels en totalité ou en partie; ii) de vendre les logiciels, de les louer, de les concéder sous licence, de les transférer ou d’en permettre par ailleurs l’accès; iii) de modifier, de retirer ou de couvrir quelque marque de commerce ou avis de propriété inclus dans les logiciels; et/ou iv) de décompiler, de désassembler, de décrypter, d’extraire ou de désosser les logiciels ou d’aider quiconque à le faire. Aucun élément dans Cours d’eau branchés ne saurait être interprété comme vous conférant un droit, un titre, un intérêt ou une autre licence dans les logiciels intégrés dans Cours d’eau branchés ou pouvant être téléchargés à partir de Cours d’eau branchés, y compris, notamment, quelque droit de propriété intellectuelle dans les logiciels. Tous les logiciels intégrés dans Cours d’eau branchés sont fournis tels quels, sans garantie de quelque nature, expresse ou implicite, y compris, notamment, une garantie i) quant à la qualité marchande ou à l’adaptation à un usage particulier des logiciels; ii) quant à la conformité des logiciels à certaines spécifications s’y rapportant; iii) quant à l’absence de défauts importants des logiciels; iv) quant à l’absence de virus ou d’autres programmes malveillants dans les logiciels; ou v) quant à la capacité des logiciels à traiter ou à manipuler des données relatives aux dates ou au temps sans interruption ou arrêt anormal.

Droit applicable et compétence

Cours d’eau branchés (à l’exclusion des sites qui y sont liés) est administré par le G3E depuis ses bureaux situés dans la province de Québec, au Canada. Lorsque vous visitez ou utilisez Cours d’eau branchés, vous convenez que toutes les questions relatives à votre visite ou à votre utilisation de Cours d’eau branchés et/ou au contenu sont régies par les lois de la province de Québec et par les lois du Canada, sans égard aux principes de conflit de lois. Par la présente, vous acceptez et reconnaissez la compétence non exclusive de la Cour fédérale du Canada et/ou des tribunaux de la province de Québec sur ces questions. Vous convenez que les dispositions de la Convention des Nations Unies sur les contrats de vente internationale de marchandises ne s’appliquent pas.

Présentations

Dans le cas où Cours d’eau branchés offre des fonctions de transmission d’information et de photos, l’utilisateur cède au G3E à titre exclusif le droit d’adapter en tout ou en partie l’information et les photos transmises ainsi que les droits de reproduction, de représentation et d’exploitation.

Le droit de reproduction concerne :

le droit de reproduire en tout ou en partie les photos et leurs adaptations sur tout support numérique;
le droit de communiquer au public les photos et leurs adaptations.
Le droit de représentation concerne :
le droit de représenter en tout ou en partie les photos et leurs adaptations à titre gratuit par projection publique, télédiffusion, transmission, diffusion ou par d’autre services technologiques de représentation.

Le droit d’exploitation concerne :

le droit d’incorporer en tout ou en partie les photos et leurs adaptations dans des œuvres numériques ou multimédia.

Lorsque vous utilisez l’une des fonctions de Cours d’eau branchés vous permettant d’afficher, de télécharger ou de faire des présentations, vous êtes tenu d’observer les règles de nétiquette et de ne pas i) gêner ou empêcher un autre utilisateur d’utiliser ou de profiter de Cours d’eau branchés, gêner ou tenter de gêner le bon fonctionnement du site ou faire quelque chose qui, à l’absolue discrétion du G3E, surcharge de façon déraisonnable ou disproportionnée l’infrastructure de Cours d’eau branchés; ii) afficher ou transmettre quelque information illégale, comminatoire, injurieuse, diffamatoire, obscène, vulgaire, pornographique, blasphématoire ou indécente de quelque nature, y compris, notamment, une présentation constituant ou encourageant une conduite qui constituerait une infraction criminelle, donnerait lieu à la responsabilité civile ou serait par ailleurs une violation de quelque législation ou réglementation locale, étatique, provinciale, nationale ou internationale; iii) afficher ou transmettre une présentation, y compris, notamment, des articles, des images, des histoires, des logiciels ou d’autre matériel qui violent ou transgressent les droits d’autrui, y compris du matériel qui constitue une atteinte à la vie privée ou aux droits à la protection de la vie privée ou qui est protégé par des droits de propriété intellectuelle, y compris, notamment, un droit d’auteur, un brevet, un secret de fabrique, une marque de commerce ou un autre droit de propriété, ou des œuvres dérivées de ce qui précède, sans obtenir d’abord la permission du propriétaire ou du titulaire des droits; iv) afficher ou transmettre une présentation qui encourage le racisme, le sectarisme, la haine ou des sévices corporels de quelque nature contre un groupe ou une personne, qui peut être préjudiciable aux mineurs, vise ou préconise le harcèlement d’une autre personne, offre du matériel à caractère sexuel ou violent dans lequel des personnes mineures sont exploitées, donne de l’information pédagogique sur des activités illicites, y compris, notamment, la fabrication ou l’achat d’armes illégales; v) afficher ou transmettre une présentation qui sollicite des mots de passe ou des renseignements d’identification personnelle auprès d’autres utilisateurs à des fins commerciales ou illégales; vi) afficher ou transmettre une présentation qui contient un virus ou un autre élément dommageable ou qui transmet ou crée des virus informatiques; vii) afficher ou transmettre des pourriels, des chaînes de lettres ou une distribution massive de messages non sollicités ou faire du pollupostage; ou viii) utiliser Cours d’eau branchés à des fins commerciales, y compris, notamment, l’affichage, le téléchargement ou la transmission de présentations qui renferment de la publicité ou qui donnent lieu à des activités commerciales et/ou à des ventes, ou qui comprennent des concours, des sweepstakes, des échanges, de la publicité et/ou des opérations pyramidales.

Lorsque vous affichez ou téléchargez des présentations dans Cours d’eau branchés, vous concédez au G3E une licence mondiale illimitée, irrévocable, non exclusive, perpétuelle et à titre gratuit i) d’utilisation, de reproduction, de stockage, d’adaptation, de traduction, de modification, de création d’œuvres dérivées, de transmission, de distribution, d’exécution publique ou de mise à la disposition du public de ces présentations à quelque fin; et ii) de concession en sous licence à des tiers du droit illimité d’exercer l’un ou l’autre des droits précités. Outre la concession de la licence susmentionnée, par les présentes, vous i) convenez de renoncer à l’ensemble des droits moraux dans quelque présentation en faveur de G3E; ii) consentez à ce que vos nom, prénom, adresse et courriel apparaissent pour votre contribution à une présentation, le cas échéant, ainsi qu’à la divulgation et/ou à l’affichage de cette information et de toute autre information qui figure dans une présentation ou qui y est associée; iii) reconnaissez et convenez que le G3E ne saurait être tenu responsable de quelque perte, endommagement ou corruption de vos présentations; et iv) reconnaissez et convenez que les présentations que vous transmettez aux fins d’affichage dans Cours d’eau branchés seront considérées comme non confidentielles. The Education and Water monitoring action Group (EWAG) has established policies to ensure the most enjoyable experience possible for everyone when using the Connected Waterways app. We invite you to consult them.

IT IS IMPORTANT TO READ ALL POLICIES AND TERMS OF USE CAREFULLY.

The G3E is the owner and administrator of the Connected Waterways application and related technological services (hereinafter referred to as “Connected Waterways”). This user agreement (hereinafter « the agreement ») stipulates the conditions of access and use of Connected Waterways. When you visit and use Connected Waterways, you agree to be bound by the terms of this Agreement. IF YOU DO NOT AGREE WITH ANY EWAG TERMS, RULES, POLICIES, GUIDELINES OR PRACTICES IN CONNECTING STREAM OPERATIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING IT.

EWAG may revise this Agreement at any time.

Use of Connected Waterways after such changes are posted will constitute acceptance of the revised terms. You are therefore invited to periodically review these policies and terms of use.

Property

Anything displayed or otherwise accessible through Connected Waterways, including, but not limited to, articles, text, photographs, images, illustrations, audio clips, video clips, software and codes (collectively « the content »), is protected by Canadian and foreign laws, including copyright, and belongs to EWAG, its licensors or the person recognized as the supplier of the content.

Branched Waterways is otherwise protected under copyright law as a collection and/or compilation within the meaning of Canadian and foreign laws. You must abide by all other copyright notices, information and restrictions relating to content that may be accessed through Connected Waterways. ANY USE, REPRODUCTION, MODIFICATION, PUBLIC PERFORMANCE OR MAKING AVAILABLE TO THE PUBLIC, UPLOADING OR POSTING ON THE INTERNET, TRANSMISSION, REDISTRIBUTION OR ANY OTHER EXPLOITATION OF CONNECTED WATERWAYS OR ANY CONTENT, IN WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED HEREIN (OR EXPRESSLY MENTIONED IN CONNECTED WATERWAYS), ARE PROHIBITED WITHOUT EXPRESS WRITTEN PERMISSION FROM EWAG.

Trademarks

Connected Waterways is the official property of EWAG. Other names, words, titles, phrases, logos, designs, graphics, icons and trademarks displayed in Connected Waterways may constitute registered or unregistered trademarks of EWAG or third parties. Although EWAG may use certain third-party trademarks under license, the display of such trademarks in Connected Waterways does not imply any relationship or license between EWAG and the owner of the trademark in question, nor endorsement of the wares, services or activities of the owner of this trademark by the EWAG. Nothing contained in Connected Waterways shall be interpreted in such a way as to grant you a license or right to use any logo, design or trademark of the EWAG or of a third party, without the written permission of the EWAG or of the owner of a third-party trademark.

Disclaimer of Warranties

CONNECTED WATERWAYS AND ALL CONTENT ARE PROVIDED AS IS. WHEN YOU VISIT AND USE CONNECTED WATERWAYS, YOU ACKNOWLEDGE AND AGREE THAT YOU DO SO ENTIRELY AT YOUR OWN RISK. THE EWAG MAKES NO REPRESENTATIONS OR WARRANTIES:

AS TO THE ACCURACY, COMPLETENESS, RELIABILITY OR TIMELINESS OF ITS CONTENT.
AS TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE CONTENT, INCLUDING THE MERCHANTABILITY OR SUITABILITY, INCLUDING PARTICULARLY, OF ANY INFORMATION, DATA, SOFTWARE, PRODUCT OR SERVICE CONTAINED IN LINKED STREAMLINES OR OFFERED THROUGH CONNECTED WATERWAYS.

AS TO THE FREEDOM OF VIRUSES OR HARMFUL ELEMENTS IN CONNECTED WATERWAYS; AND
AS TO THE SECURE OR UNINTERRCEPTED TRANSMISSION OF COMMUNICATIONS THROUGH CONNECTED WATERWAYS.

Registration

You can access most of the content of Connected Waterways without registering and without providing us with any personal information. However, to use certain features of Connected Waterways, you may be required to register. You agree (i) to provide true, accurate, current, and complete information about yourself when prompted to provide it in a registration form; and (ii) to maintain and promptly update the information you provide in order to keep it true, accurate, current and complete. If the EWAG has reasonable grounds to believe that this information is false, inaccurate, outdated or incomplete, it has the right to suspend your right to visit and use Connected Waterways (or part of this one) or to end it. EWAG’s use of any personally identifying information you provide to EWAG as part of the registration process is governed by the terms of EWAG’s Privacy Policy located at: https: //www.g3e-ewag.ca/confidentialite/.

You are responsible for maintaining the confidentiality of your password and account, and you are responsible for all activity conducted using them. You agree to notify EWAG immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. EWAG shall not be liable for any loss or damage resulting from EWAG’s failure or your failure to protect your password or account information.

The information collected during registration allows the EWAG to create your account and provide you with easy and personalized access to it. They also allow the EWAG to offer and ensure Connected Waterways services. This information also allows it to communicate with you about your use of Connected Waterways and software updates, and to respond to your requests for assistance (including assistance with account verification if you have difficulty accessing yours). Your information will not be used to send prospecting emails or other special offers of a commercial nature.

Privacy

As soon as you access Connected Waterways, some data is automatically transmitted to the EWAG. These data are collected under the technological requirements specific to Internet browsing and mobile applications and are only used for statistical purposes.

Connected Waterways collects and receives information from your mobile device, name (or username), email, password, geographic coordinates, photos and information entered for stations documented.

On request, it is possible to anonymize a user’s stations by transferring their stations to an anonymous account and deactivating the user account. Photos, geographical coordinates, texts entered would still be visible, but without being associated with a user.

The EWAG ensures the anonymity of the information it keeps and which it needs to determine the number of visitors, the most frequented pages, the technology used, the referring sites and the country of origin of the users, etc.

Connected Waterways users are advised not to disclose personal information, or to take appropriate security measures if they do.

However, if you decide to send us personal information (by sending us a message by e-mail or by other means through Connected Waterways), the EWAG undertakes the following commitments:

Only persons qualified to receive it at EWAG will have access to this information and they will only be able to consult it when necessary for the performance of their duties.

Limitation of Liability

SUBJECT TO APPLICABLE LAW, EWAG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY LOSS OR DAMAGE OF NATURE OR ARISING FROM LOSS OF BUSINESS, LOSS OF SAVINGS, LOSS OF DATA AND/OR LOSS OF PROFITS, WHATEVER WHETHER CAUSED, AND WHETHER OR NOT BASED ON CONTRACT (INCLUDING BREACH OF ESSENTIAL DUTY), CIVIL LIABILITY (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF EWAG KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL EWAG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS BE LIABLE FOR ANY DAMAGES OR LOSSES UNDER THIS AGREEMENT, WHETHER OR NOT BASED ON ANY CONTRACT (INCLUDING BREACH OF ESSENTIAL DUTY), CIVIL LIABILITY (INCLUDING NEGLIGENCE) OR OTHERWISE IN EXCESS OF ONE HUNDRED CANADIAN DOLLARS ($100 CAD), EVEN IF EWAG KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL EWAG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM EWAG’S FAILURE OR YOUR FAILURE TO PROTECT YOUR PASSWORD OR YOUR ACCOUNT INFORMATION. THE EWAG EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS, OR CONDUCT OF ANY THIRD PARTY CONNECTED WATERWAYS USER OR ANY CONNECTED WATERWAYS ADVERTISER OR SPONSOR (COLLECTIVELY, A « THIRD PARTY USER »).

IN NO EVENT SHALL EWAG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS OR THEIR RESPECTIVE SUCCESSORS AND ASSIGNS BE LIABLE FOR ANY DAMAGES, LOSSES, DAMAGES (INCLUDING SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES) OR D ‘NO CHARGES ARISING IN ANY WAY (I) FROM THE ACTS, OMISSIONS OR CONDUCT OF A THIRD-PARTY USER; AND (II) THE USE OR INABILITY TO USE ANYTHING, SOFTWARE, CONTENT, GOODS OR SERVICES OF A SITE OR OFFERED THROUGH A CONNECTED WATERWAYS LINKED SITE.

IF YOU DECIDE TO VISIT OR USE A CONNECTED WATERWAYS LINKED SITE, OR ANY CONTENT, MATERIALS, SOFTWARE, GOODS OR SERVICES FROM ANY CONNECTED WATERWAYS LINKED SITE, YOU DO SO ENTIRELY AT YOUR OWN RISK.

YOU HEREBY RELEASE EWAG AND ITS OFFICERS, DIRECTORS, AGENTS AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS FROM ANY LIABILITY FOR ANY DAMAGES YOU MAY SUFFER, AND YOU AGREE NOT TO SET UP ANY CLAIMS AGAINST THEM. ARISING FROM YOUR PURCHASE OR USE OF PRODUCTS OR SERVICES OFFERED THROUGH CONNECTED WATERWAYS, INCLUDING BY THIRD PARTIES.

The information contained in Connected Waterways is provided for informational purposes only. It is not intended to be legal, accounting, tax, investment, financial, medical, or other advice, and you should not rely on this information to obtain such advice.

Security

Please note that, in general, information sent or received via the Internet is not secure, and EWAG cannot and does not make any representations or warranties regarding the security of any communication through the Connected Waterways Intermediary, or any representations or warranties regarding the interception by third parties of information, including personal information.

Hyperlinks

Connected Waterways contains hyperlinks to third party sites. These hyperlinks are offered only to facilitate your consultation and cannot be interpreted as an approval of the content of these third-party sites by the EWAG. EWAG may at any time, without notice, in its absolute discretion and without cause, terminate your right to visit and use Connected Waterways (or any part thereof). EWAG may also terminate your right to visit and use Connected Waterways, or any part thereof, if you breach any of the terms of this Agreement.

Software Licenses and Ownership

All software incorporated into or found in Connected Waterways, including, without limitation, any type of machine code and all files and/or images contained or generated by such software, is protected by copyright. copyright and may be protected by other rights. All such software belongs to EWAG, its licensors or recognized proprietary parties. You are hereby authorized to access and use the software integrated into Connected Waterways, subject to (i) the terms of this agreement and (ii) the other conditions of access to and use of such software. which can be imposed. If Connected Waterways offers software downloads, unless otherwise provided, you hereby receive, subject to (i) the terms of this Agreement and (ii) other terms and conditions that may apply to the download and use of such software, a non-exclusive, non-transferable, personal license (i) to install and use one copy of the software in object code format on an off-network computer for personal, non-commercial use and (ii) to reproduce the software in as reasonably necessary for its installation and operation, and for the creation of reasonable backup copies as permitted by law. Except as expressly permitted in this Agreement, you are prohibited from (i) using, reproducing, modifying, adapting, translating, downloading or transmitting the Software in whole or in part; (ii) sell, rent, license, transfer or otherwise allow access to the Software; (iii) modify, remove or cover any trademark or proprietary notices included in the Software; and/or (iv) decompile, disassemble, decrypt, extract or reverse engineer the Software or assist anyone to do so. Nothing in Connected Waterways shall be construed as conferring on you any right, title, interest or other license in any software embedded in Connected Waterways or downloadable from Connected Waterways, including, without limitation, any intellectual property rights in software. All the software included in Connected Waterways is provided as is, without warranty of any kind, express or implied, including, in particular, a warranty i) as to the merchantability or the adaptation to a particular use of the software ; (ii) as to the compliance of the software with certain related specifications; (iii) as to the absence of material defects in the software; (iv) as to the absence of viruses or other malicious programs in the software; or (v) the ability of the software to process or manipulate date or time data without interruption or abnormal termination.

Applicable law and jurisdiction

Connected Waterways (excluding linked sites) is administered by EWAG from its offices within the Province of Quebec, Canada. When you visit or use Connected Waterways, you agree that all matters relating to your visit or use of Connected Waterways and/or the Content are governed by the laws of the Province of Quebec and by the laws of Canada, without regard to principles of conflict of laws. You hereby consent and acknowledge the non-exclusive jurisdiction of the Federal Court of Canada and/or the courts of the Province of Quebec over such matters. You agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Presentations

If Connected Waterways offers functions for the transmission of information and photos, the user assigns to EWAG the exclusive right to adapt all or part of the information and photos transmitted as well as the reproduction, representation, and exploitation rights.

The right of reproduction concerns:

the right to reproduce all or part of the photos and their adaptations on any digital medium.
the right to communicate the photos and their adaptations to the public.
The right of representation concerns:
the right to represent all or part of the photos and their adaptations free of charge by public projection, television broadcasting, transmission, distribution or by other technological representation services.

The right of exploitation concerns:

the right to incorporate all or part of the photos and their adaptations into digital or multimedia works.

When using any of the features of Connected Waterways that allow you to view, download or make presentations, you are expected to observe the rules of netiquette and not to (i) hinder or hinder any other user use or enjoy Connected Waterways, interfere or attempt to interfere with the proper working of the site, or do anything that, in EWAG’s absolute discretion, unreasonably or disproportionately overloads Streams infrastructure water plugged; (ii) post or transmit any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including, without limitation, a display constituting or encouraging conduct that would constitute a criminal offense, would give rise to the civil liability or would otherwise be a violation of any local, state, provincial, national or international law or regulation; (iii) post or transmit any submission, including, but not limited to, articles, images, stories, software, or other material that violates or infringes the rights of others, including material that is injurious to life privacy or privacy rights or which is protected by intellectual property rights, including but not limited to copyright, patent, trade secret, trademark or other proprietary right. ownership, or derivative works of the foregoing, without first obtaining permission from the owner or rights holder; (iv) post or transmit any material that promotes racism, bigotry, hatred or physical abuse of any kind against any group or individual, that may be harmful to minors, aims at or advocates the harassment of another person, offers material of a sexual or violent nature in which minors are exploited, provides educational information on illicit activities, including, in particular, the manufacture or purchase of illegal weapons; (v) post or transmit any presentation that solicits passwords or personal identification information from other users for commercial or unlawful purposes; (vi) post or transmit any Submission that contains a virus or other harmful component or that transmits or creates computer viruses; (vii) post or transmit spam, chain letters or mass distribution of unsolicited messages or engage in spamming; or (viii) use Connecting Streams for any commercial purpose, including but not limited to posting, uploading or transmitting presentations that contain advertising or that result in commercial activities and/or sales, or which include contests, sweepstakes, barter, advertising and/or pyramid schemes.

When you post or download presentations in Connected Waterways, you grant EWAG an unlimited, irrevocable, non-exclusive, perpetual, worldwide license free of charge (i) to use, reproduce, store, adapt, translation, modification, creation of derivative works, transmission, distribution, public performance or making available to the public of these presentations for any purpose; and (ii) sub-licensing to third parties the unlimited right to exercise any of the foregoing rights. In addition to granting the foregoing license, you hereby i) agree to waive all moral rights in any Presentation in favor of EWAG; (ii) consent to your first and last name, address and email appearing for your contribution to a presentation, if any, and to the disclosure and/or posting of this information and any other information contained in a presentation or associated with it; (iii) acknowledge and agree that EWAG shall not be liable for any loss, damage or corruption of your Submissions; and (iv) acknowledge and agree that Submissions you submit for posting to Connected Waterways will be considered non-confidential. Although EWAG cannot and will not review Submissions prior to their posting, it reserves the right, in its absolute discretion, to edit or remove any Submission whether or not it conflicts with the provisions hereof or otherwise reprehensible. You acknowledge and agree that EWAG may, in its absolute discretion, monitor Connected Waterways on a regular basis and disclose information necessary to comply with any legislation, regulation or other governmental or judicial request, necessary for the proper operation of Connected Waterways or to protect themselves or other users of Connected Waterways. Any disclosure will be made in accordance with EWAG’s Privacy Policy. The EWAG is not responsible for the content of the presentations. These represent the opinions and opinions of the people who post them and not those of the EWAG. Although the latter is under no obligation to investigate a complaint about a presentation, he may, in his absolute discretion, investigate complaints and take such action as he deems appropriate in the circumstances, including, without limitation, removing from Connected Waterways the communication in question and terminate the rights of access and use of Connected Waterways (or part thereof) of the party who is the author.

General

EWAG’s consent to or waiver of any express or implied breach by you of this Agreement shall not constitute consent or waiver of any other different or subsequent breach. You may not assign or transfer this Agreement or any rights and/or obligations hereunder. If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid, it shall be severed, and the remaining provisions shall remain in full force and effect without being invalidated in any way. This Agreement does not create a partnership, joint venture, or agency relationship between the parties. Except for agreements with EWAG that expressly reference this Agreement, this Agreement constitutes the entire agreement between you and EWAG with respect to the subject matter.
